Bug 40309: Make the existing patch for 40309 more similar to Firefox's code

Pier Angelo Vendrame requested to merge pierov/tor-browser:bug_40309_fix into tor-browser-91.9.0esr-11.5-1

This modifies the patch for #40309 (closed) that we've been using so far (e.g., 68a0dfde), to act only when the RFP preference is enabled.

The objective is to then uplift it to Mozilla.
